COUNCIL VOTES TO SEND CITY’S MEDICAL MARIJUANA ORDINANCE UP IN SMOKE

LBReport.com has learned that in an Oct. 11 closed session, the City Council voted 8-1 (Rae Gabelich dissenting) to direct the City Attorney to prepare an ordinance that, if enacted, will repeal the city’s current medical marijuana ordinance — and ban medical marijuana collectives/dispensaries in Long Beach — with the understanding that the issue may be reconsidered at such time as the California Supreme Court clarifies the law in this area.
The action comes in the wake of a three-judge California Court of Appeal ruling that held key parts of Long Beach’s current medical marijuana ordinance are unenforceable under federal law.

Federal law, in the form of the Controlled Substances Act, needs to be changed…by Congress…and not merely interpreted by the Supreme Court.
Looks like there will be a lot of empty storefronts and lawsuits on the horizon. More incompetence by our fine group of city leaders. How can so many smart people be so stupid? Just goes to show you how our education system has failed us in this great country.
City should:
l.Repeal its ill advised ordinance.
2.Spend NOT ONE FURTHER TAX DOLLAR ON ANY APPEAL.
3.If Robert Shannon wants to appeal he can do so on his own dime
and time–but time has come for taxpayers to stop funding is
dubious judgment.

First, us taxpayers will need to pay back the $800,000 our not so wonderful CITY COUNCIL collected in fees from groups applying for a medpot lottery license. Then taxpayers will have to pay for all of the law suits brought on by the illegal enforcement actions that closed down medpot businesses in accordance with CITY COUNCIL’s illegal medpot ordinance.
Isn’t it wonderful how our MAYOR and CITY COUNCIL throws away taxpayers money on activities judged illegal by California courts. You would hardly know the city is laying off city workers and reducing services because the city is broke.

This opposition to the City’s ordinance was out in the open before its passage, right? In other words, the City knew (or should have known) that it was on shaky legal ground.
On the other hand, can something (anything) be done about the “dispensaries” popping up on every street corner? Common sense tells me that this is semi-legal pot dealing and not “medicine”.
…and for the record I have nothing against legalization. I just think the current system is a sham.
With all the grow houses going in the LBC the fire sales will be great, prices will go down now that the govt is not involved. Alot of people have already gone back to their dealers cause the prices are lower and no hassle with a ‘recommendation’ ($$) for the same product the despensaries sell.
The city screwed up because they saw MONEY and got greedy.
